Tech question for DM re DVD music on the air

Sittin' around thinking, as I do every now and then....

The Rolling Stones released a 3-DVD set a couple of years ago. This set contains a sublime version of a song I've always loved, "Can't You Hear Me Knockin".

Suppose I requested this version be played on the Marsden show.

Is it technically possible to play the audio from a DVD on NYTS.com?

Are there copyright issues with this? Is it legal?

I have asked a similar version of this question. Absence of response led me to my own research.

nythespirit.com pays royalties to SOCAN for all material played, regardless of how it is sourced, based on a percentage of subscription fees paid by listeners. SOCAN deals with re-distributing the wealth among the artists in an appropriate fashion.

And if you believe that last bit, I have some prime land in Florida for sale...

Anyway, google, or better, startpage on SOCAN. Follow the breadcrumbs to the formula for payment of royalties by online streaming services.

Someone will correct me if this is misleading, it is not intended as such.

I looked at SOCAN's page maybe a couple of years ago, and left confused.

Thought Marsden, having been in the business practically forever, might know off the top of his head.

I remember when my mom made me turn Dave Mickie off. "I CAN'T STAND THAT GUY" she said. I'll never forget that day. 8-)

As Sunbeam has noted we are licensed by/to SOCAN. Beyond that, I would have to have our lawyer explain the many details of that license.

In addition to receiving payment for play - artists also receive tremendous promotional value. In days past that meant selling records. Today it primarily means selling songs.

That's why on our player we provide click-through buttons for both 7Digital & ITunes.

Hear a song you like. If the button is lit up you can buy that song. At that moment click the button of your choice and buy that song right there right then. Instantly you have that song. 24/7 and you didn't have to leave home.

Sometimes technology is kind of great.

Ok, but let's go back to my original question... there is a killer version of "Can't You Hear Me Knockin'" on a DVD.

Can you play it on your show? If you're not sure if it's legal, just say so. If you're sure it's illegal, then fine. I'm just asking.

If we need lawyers to answer this question, then forget it. I don't want to know that badly.

I don't see any problem with playing it provided all the required information is available. I will begin my search tomorrow. Dubbing from a DVD does risk the audio quality.....meaning I will try and find it through other sources.

There's the rub... unless the band has released an audio CD to match the DVD, a la "Stop Making Sense", you are not going to find other sources. The DVDs are the only source.

Why would you need to dub? Is it not possible to just play the DVD and feed the audio to air? I'm thinking it should be, it's all digital, right? That's why I entitled the thread "tech question". :mrgreen:

I'm not trying to give you a hard time, I am genuinely interested.

There are a lot of concert DVDs with excellent performances by the artists. And movie DVDs with fabulous songs on the soundtrack.

All this stuff is digitally encoded into a series of 1's and 0's.

The software you are using to stream NYTS certainly understands a stream of 1's and 0's, so I don't see why it would be technically difficult to broadcast DVD audio.

Legally it's a different story.

I would like to hear what your tech people say about this. But I also recognize this is just a hobby site and maybe those tech people can't be bothered... 8-)

Big EarIs Teddy - am aware you are not trying to give us a hard time.

The reality is both Marsden Global and NYTheSpirit are essentially run by 2 people. Myself and business partner Igor Loukine. And of course, our 5 DJs who work very hard to deliver amazing shows each week. With that in mind, you can imagine how much of our time is spent keeping both fresh and interesting.

Because we are very particular about both the look and the sound of NYTheSpirit we do add more and newer music every week. However - there is a little more involved than just crossing over an audio file. Anyone can do that. But we want it to be the best.

If my follow ups to your questions seems to take a while it may be because I truly don't know the answer OR I/we are busy with other elements of the two sites.

Our intent from the beginning has been to make Marsden Global and to a much larger extent NYTheSpirit successful. Everyone's help in that regard is always appreciated.

Geeze, don't ever worry about something like that. I am fully aware that NYTS.com is of paramount importance and these forums are just a sideline. That's how it should be. 8-)
